Sponsor and Exhibitor Contract Agreement

TITLE AND TAX:

Electric BodyMod, DBA, herein referred to as “Organizer” and Sponsors, Vendors and Artists herein referred to as “Exhibitor”. Exhibitor is required to obtain all required license(s), permit(s) and to collect and report all sales tax generated at the show as required by local and/or state governemnt agencies.

EXHIBITOR SPACE:

Up to 2 registered artists (Tattoo Artists/Body Piercings) per booth will be permitted to tattoo at any given time – no exceptions will be made. Body piercings must be approved. To maintain a standard, we request a $31 minimum or a $31/hour for tattoos and a $28 minimum for body piercings – these prices are lowered to reflect Friday the 13th sale prices should you choose to lower your prices for the sale weekend.

The organizer will provide an 8’x10′ back drape, 3′ side drapes, 2 tables, 2 chairs, 1 BioHazard sharps container, 1 trash bin, 1 gallon of distilled water and electricity.

Exhibitors must provide their own furnishings, lights, extension cords and power strips. All booth decorations installed by the Exhibitor must be made of Fire Marshall-approved materials.

Exhibitor will be held responsible for any damages to booth structure or Visalia Convention Center, 303 E. Acequia Ave., Visalia, CA 93291 incurred during occupancy of their space. Nothing shall be tacked, nailed, screwed or otherwise attached to drapes, walls, floors, trees or other parts of the facilities.

EXHIBIT HALL SET-UP:

Access to load items into the convention centers’ Exhibit Hall will be available on Saturday, September 14, 2024 at 6:30 AM – 10 AM. All large items and cars must be removed from load in area by 10 AM. Access will not be available after. Access to load items into the convention center will also be available Sunday, September 15, 2024 from 9 AM – 10 AM. All large items and cars must be removed by 10 AM. Access will not be available after. All Exhibitors shall finish set-up 30 minutes prior to doors opening to the public.

EXHIBIT HALL TIMES:

The exhibit hall will be open to the public at 11 AM to 11 PM on Saturday, September 14, 2024 and 11 AM – 9 PM on Sunday, September 15, 2024. The exhibit hall will be closed and secured Saturday night by 12 AM.

EXHIBIT HALL TEARDOWN:

No exhibit space may be removed until 8 PM Sunday, September 15, 2024. Violation of the teardown rule will result in loss of seniority for next years event as well as a $200 early closing fee. All booths must be vacated by 11 PM Sunday, September 15, 2024 and BioHazard sharps containers must be put at the front of the booth. Organizer will dispose of the BioHazard sharps containers.

EXHIBITOR STORAGE:

Organizer assumes no responsibility for stored items/ valuables and will not provide crates on site. Exhibitors are in charge of recieving their own deliveries. Organizer cannot accept deliveries for any exhibtors.

EXHIBITOR WRISTBANDS:

Each booth will be issued 3 exhibitor wristbands/lanyards. You must wear the wristband at all times. Additional wristbands/lanyards are available to purchase for $25 USD each. If you or someone from your booth is caught sharing wristbands/lanyards, you will be ejected and your shop booth will be closed for the remaining portion of the show with no refunds. You are required to wear the exhibitor wristbands the entire time of the show during show hours.

ARTIST CLIENTELE RULES:

Must be 18 years or older to get a tattoo. All private areas/genitals must be covered. Body piercing of the nipples must be screened from public viewing. If the Exhibitor plans to offer this service they must provide their own opaque screen as one will not be proivided by the Organizer. No metal tubes – all tubes must be disposable. Artists must use machine bags and grip sleeves. No metal piercing tools. Piercing jewelry must be pre-autoclaved/pre-sterilized and be used for initial piercings only. Piercers must have printed records of autoclave info/tests (I.E.: CrossTex).

ALCOHOL AND DRUGS:

Alcohol and drugs are NOT permitted at the artist booths. Alcohol is only allowed in the convention hall if purchased from the alcohol vendors located in the Visalia Convention Center Courtyard. Drugs are strictly prohibited from the convention center grounds. The responsibility is on the Exhibitor that no clients should recieve body art if they are judged to be intoxicated.

IDENTIFICATION:

Legal age requirement is 18 years old and will be strictly enforced for all tattooing and body piercing with proof of ID. No work shall be performed on any individual under the age of 18.

STERILIZATION PROCEDURES:

All needles must be single-use and disposed of in the BioHazard sharps container. All exhibitors must use disposable tubes/cartridges. All piercing tools must be single use and disposable.

CLIENT AND PRACTITIONER HEALTH RELATED INFORMATION:

Please supply each client with an aftercare sheet – an aftercare sheet will be provided to you by the Organizer at check-in. Artists and vendors are responsible for making sure the client recieves and understands the aftercare sheet provided to them.

BODY PIERCING AND MODIFICATIONS:

Body piercing services must be pre-approved by Organizer in writing. Body piercings are allowed except for the following: genitals, tongue splitting, scalpeling, cutting and branding. WORKSTATION REQUIREMENTS:

Anyone not being tattooed is prohibited from being inside the booth. Fresh tattoos pose a threat of cross contamination so please bandage your clients cleanly and safely. All tattoos performed at the convention must be bandaged prior to the client leaving the booth. Bandages may be removed for the purpose of entering the tattoo contest.

CLEANING:

Exhibitors must keep booth space clean and presentable to the public. Trash cans should be put at the front of the booth at closing for removal by facility maintenance personnel.

SECURITY:

The Organizer procides security and will exercise reasonable precaution for protection of property of Exhibtors but maintains no responsibility for loss or damage incurred during the rental period.

SOUND DEVICES:

Sound amplification devices must have prior approval from Organizer. Amplified solicitation above a normal tone of speaking voice will not be allowed. Objectionable sound and lyrics will not be tolerated. Selling or giving of gifts upon which noise can be made will not be allowed.

SOUVENIR POLICY:

No merchandise that has show name, logo or artwork will be sold without prior written approval of the Organizer. No merchandise with the names “Official Annual”, “Official Souvenior”, or “Commemorative” is permitted to be sold. There will be official stands at the show with offical souvenirs with the shows logo/name.

ADVERTISEMENT AGREEMENT:

The Exhibitor hereby authorizes the Organizer to publish the name and logo in the following ways including but not limited to: banners, backdrops, posters, billboards, flyers, DJ, announcements, newspaper articles, program pamphlets, magazines, tickets, tickets booths, plaques, main stage, various social media platforms, video recordings, audio recordings and other marketing materials which the Organizer elects to publish.

TERMS AND CONDITIONS:

The agreement shall not be binding until accepted by the Organizer. Exhibitor shall not be entitled to exhibit in said exhibit space unless the rental fee has been paid in full within the expressed time frame. This agreement shall not be re-assignable by the Exhibitor. A deposit of 50% made by Exhibitor is due upon acceptance of this signed agreement by Organizer. The remainder of the balance shall be due within 4 weeks of acceptance. There will be no refunds for failure to meet this deadline or for unoccupied space leased. Checks will not be accepted, payments will be made through a credit or debit card. Organizer shall have full power to interpret and enforce all rules contained herein and the power to make ammendments thereto. Organizer shall retain full power to enact such further conditions of agreement as it shall consider necessary for the proper conduct of the exhibition. Exhibitor will not be entitled to recover payment from Organizer regarding any consequential damages to property, or loss of use, loss of time, loss of profits or loss of income that may arise out of Organizers’ enforcement of the Terms and Conditions of this contract.

INDEMNIFICATION:

By signing the agreement the Exhibitor shall defend, indemnify and hold harmless The Visalia Convention Center, Electric BodyMod,DBA, their parents, subsidiaries, affiliates, directors, officers, employees, insurers and agents herin from and against all claims, damages, losses and expenses, including attorneys’ fees arising out of or resulting from the acts, errors, omissions, conduct or operations of the Exhibitor, provided that any such claim, damage, loss or expense (1) is attributable to bodily injury, sickness, disease or death or to injury to or destruction of tangible property, including the loss of use resulting there-from, and (2) is caused or is claimed or alleged to have been caused, in whole or in part, by negligent act, error, omission, conduct or operation of the Exhibitor, or any subcontractor, or anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable, or (3) is abused or is claimed to have been caused, in whole or in part, by any product sold or service rendered by the Exhibitor, its agents, employees or subcontractors.

PROPERTY DAMAGE:

Organizer shall not be held responsible for any loss or damage to property of other party hereto including, but not limited to, loss or damage occasioned by theft, fire, smoke, natural disasters, public enemy, riot, civil commotion or other insurable hereto with espect to any loss or damage. It shall be the responsibility of the Exhibitor, respectively, to secure their own insurance or otherwise protect themseleves and its properties against any such loss or damage.

UNAVAILABILITY OF BOOTH SPACE:

In the event booth space is leased or any portion, thereof is not available for occupancy upon the commencement or during the term of his agreement due to fire, casualty, natural disasters, struck, civil commotion, national emergency or any other cause beyond the control of Organizer. This agreement and obligations of Organizer and Exhibitor hereunder shall terminate, and Exhibitor hereby waives any claim against Organizer for damages because of such termination, provided however that any unearned portion of the lease fee due shall abate, or, in the event the show is rescheduled to a later date the Exhibitors cost will be transferred to the new show date.
